INTRODUCTION

www.adamkosmima.gr is an online store selling jewelry through the Internet created by the company under the name ADAM CH. TSAROUCHIS, based at 41 PATREOS Street P.C. 26221 Patras, with A.F.M. 068450666 and Tax Office C’ PATRAS. The following terms and conditions will apply to the visit and use of the e-shop. Every user who enters in order to make use of the services of the e-shop is considered to consent and unconditionally accepts the following terms, without exception. If a user does not agree with the following terms, then he/she must not make any transaction through the online store.

GENERAL TERMS OF USE

The company has the right to modify or revise freely the terms and conditions of transactions from the online store, whenever this is deemed necessary. It is obliged to immediately inform consumers of any modification through its website. Also, the company is entitled to make a change in the prices of the products available in the online store. Contracts drawn up through the e-shop are always carried out in Greek.

PROVIDED PRODUCT INFORMATION

The company is committed to the accuracy and completeness of the information on the products available in the online store, as well as on all the information provided regarding the realization of transactions. The company is not responsible and is not bound for errors due to error during the entry of electronic data in the store.

LIMITATION OF LIABILITY

The company in the context of its transactions from the online store is not responsible for further damages that may arise from the execution or not of orders or from the delay of execution, for any reason. It is not liable civilly or criminally for any damage (positive or consequential) suffered by a customer of the e-shop regarding the operation and use of the e-shop.

ORDERING PROCESS

AVAILABILITY OF PRODUCTS The customer is accurately informed about the availability of products available through the online store. If there is unavailability of only one part of the products ordered by the customer, the rest of the order, i.e. the products that are available, the order is executed normally. The various product offers displayed in the online store (with the indications “Brochure Offer”, “Offer”, “Web Opportunity”, “Discount” or similar expressions), are always valid until stocks run out. Prices and products marked with the leaflet, the offer marking or are an offer of limited duration are valid until stocks are exhausted and each customer can purchase a single piece. For these items, a strict order of time priority is observed in the execution of orders. SUBMIT AN ORDER The user of the e-shop, if he wishes to place an order, has the ability to submit through the special form to the online store (“order basket”) the order in which he/she includes the products and services he/she wishes to purchase. The order is not binding on the company before it confirms its acceptance as below. Before submitting the order to the customer, the following are notified, as terms of sale and the customer for the transmission of his order, declares beforehand with the marking of the indication “I have read and accept the Terms of Use” that he has been explicitly informed and accepts the following information that through the order and the special link are communicated to him, namely:
  • The characteristics of the products he ordered.
  • The failure of the customer to be adequately informed does not fall under the responsibility of the company but is his sole responsibility.
  • The identity of the business, its address, telephone number, fax number and e-mail address.
  • The total price of the products, including VAT and any other charge, as the order reflects all additional shipping, delivery or mail charges (also calculated in the body of the order) and any other expenses.
  • The listed prices of the products on the website of each product are always the final ones (i.e. including the corresponding VAT).
  • The arrangements for payment, delivery, execution, the deadline within which the company undertakes to deliver the products, the policy applied by the company to deal with complaints, the conditions, the exceptions, the deadline and the procedures for exercising the right of withdrawal.
  • Reminder of the existence of the seller’s liability for actual defects and lack of agreed properties under Articles 534 et seq. of the Civil Code, where an agreed capacity is understood only if it has been agreed in writing.
  • Where applicable, the minimum duration of the consumer’s obligations under the contract.
  • Where applicable, the existence and conditions for depositing money to be paid or provided by the consumer at the request of the supplier.
  • Where applicable, the possibilities of operating the digital content, together with the applicable technical protection measures.
  • Where applicable, any standard interoperability of digital content with hardware and software of which the undertaking is aware or reasonably expected to be aware.
  • Where applicable, the possibility of having recourse to an out-of-court complaints and redress mechanism to which the undertaking is subject, as well as the means of accessing it.
  • The obligation to pay by submitting the order if there is such an obligation by activating a selection icon with a legible marking that reads “order with obligation to pay”.
  • Whether there are restrictions on delivery and which means of payment are acceptable.
ORDER RECEIPT CONFIRMATION Each order of the customer is always followed by an automated e-mail, within a short time, on behalf of the company, which includes the confirmation of receipt of the order and repeats its content. This e-mail on behalf of the company is only confirmation that the order has been received with the content mentioned and in no way constitutes acceptance of the order or conclusion of terms of sale. No modification of the order or a new agreement on it shall be accepted unless it is printed in writing and accepted by both sides.

PRODUCTION PERFORMANCE – SALE REQUIREMENT

Upon receipt of the order and the above confirmation of its receipt, if the company ascertains the availability of the item and the correctness of the order and the absence of any errors in the online store regarding the pricing of the items, their characteristics, etc. with new e-mail, it will confirm the acceptance of the order, its content,  the preparation of the sale and the expected time of delivery of the item as already notified before the submission of the order, so that only then the sale is considered to have been drawn up and gives rise to claims on both sides. In the event that the delivery area is not covered by the company’s distribution network, the customer is informed in advance of the shipping charge and assumes himself any relevant obligation towards the carrier. The business is exempt by handing over the item to the carrier chosen by the customer. The company is not obliged in any case, based on the principle of good faith and the habits of transactions, to accept an order and to conclude a sale of products or services, which appear in the online store, due to a typographical or computer error, with an incorrect price, that is, different from the one in force based on its pricing policy for the said period. In the event that in an order such an error in the price is found in only part of the ordered items, then the order is normally valid for the rest of the items only and is considered non-starting for the items in which an error was found, except in the case that the items in the order are related, will be used as a whole and have a follow-up character with each other and the customer declares that the partial fulfillment of the order does not serve the needs or his interests, in which case the company must cancel the entire order. No additional charge to the order is borne by the customer without his explicit consent. The shipment of the order for approval to the company is a statement of acceptance and consent for all charges that are included in the order. If there is no consent, the customer is entitled to a refund of this payment. Also, in case of shipment of unsolicited products or services, their non-repudiation or omission of their return and the indifference of the customer is not interpreted in any way as consent, acceptance or declaration of will to purchase them. In the event that he/she is asked for a return by the company and he/she is late in delivering the items for return for more than two (2) working days, then his/her refusal constitutes a declaration of willingness to purchase the items and the items are considered sold to the customer and he/she must pay their value in cash. The customer also has the ability to be informed about the progress of the order, either by phone at 2610 277734, or by sending an e-mail to info@adamkosmima.gr.

ORDER CANCELLATION

Cancellation of the order is made within 2 hours of the completion of the order. Contact us directly at: 2610 277734 and a partner will undertake the cancellation of your order. In the event that the customer before the cancellation statement on his behalf has paid the value of his approved order and the business has already received it, then the company must within a period of fourteen (14) calendar days to return to the customer the collected value in the same way that he hastened the payment. Otherwise, in case a payment order has been given on behalf of the customer but the money has not been collected by the business (as for instance in the case of a credit card debit order, however, when the Bank has not yet paid the price to the business), then the company is obliged within the deadline of fourteen (14) working days to expedite any necessary action and statement to each competent body (Bank, etc.) for the notification of the cancellation of the order and the  obligation to re-pay any amount charged against the customer. In this case, the company is considered to have lawfully fulfilled its obligations, and the cancellation of any charge will be made on the basis of the terms of the contract that connects the customer with this third party (Bank, etc.) and the company bears no responsibility regarding the time of return or reversal of any relevant charge.

PAYMENT METHODS

CREDIT – DEBIT – PREPAYED CARDS

Ability to pay through credit, debit and prepaid cards of Visa, Master Card, Maestro, Diners, through attica bank platform. The use of your credit card for your purchases in the online store “adamkosmima.gr” is completely safe, as long as you follow the relevant instructions. Once you have completed all the details required for the registration of the order, you will be automatically transferred to the secure site of Attica Bank where you will be able to fill in your credit card details directly. In order to pay by credit card, you will need to fill in the relevant form the exact holder’s name, the number and expiration date of your credit card, as well as the three-digit number (CVV) located on the back of the card. The check and payment is made immediately, if you are connected to Attica Bank. In any case of purchase, the buyer should also be the cardholder used for each transaction.

CASH ON DELIVERY

The customer pays with the delivery of the order at his place, the employee of the courier company. The cash on delivery service is charged at a cost of 2€.

SHIPPING METHODS

Our goal is to deliver the order to you in the shortest possible time, simplifying the shipping process.

SHIPPING TO GREECE

For orders in Greece there will be a shipping charge of 3 Euros. For orders over 50€ shipping is free of charge. The products you ordered are sent to the address you have given us, through the courier company “ACS”. The “adamkosmima.gr” reserves the right to use another courier company.

PRODUCT DELIVERY

Within 3 to 4 working days for mainland Greece, Crete and the islands (we are always talking about delivery to the Capitals of the Prefectures and not to remote areas), as long as the products you have ordered are available. The above deadlines do not apply in times of bad weather, strikes and in any case of force majeure that may affect the delivery times. In case a product is not immediately available, you will be informed in a timely manner by the order department of the estimated delivery time.

CHANGES – RETURNS – PRODUCT REPLACEMENT

For all cases where you wish to return or replace the product you purchased, you must inform us within seven (7) days of receipt at the e-mail address “info@adamkosmima.gr” by notifying us of the reason for return or replacement and by filling in a contact number. Then a partner from the transport company will contact you to receive the return package. Alternatively you can contact us at 2610 277734 (Shop Opening Hours). Conditions for return: 1. the product must not have been used 2. the return must be made within fourteen (14) calendar days 3. the product must be accompanied by the original proof of purchase (Retail Receipt, Invoice, Shipping Note-Invoice, etc.) 4. and be in the condition received by the customer, complete and without damage, and its packaging must be the one that normally accompanies the product. In order for the products to reach good condition, you must pack them properly -in a larger box- so that they are protected during shipment. You have the right to return the products you purchased and request their replacement for the following reasons:
  1. WRONG SHIPMENT OF PRODUCT: In those cases where, through proven fault of the “adamkosmima.gr”, products were delivered to you in a different design than that of the order, you can return the products. The return of the product is free of charge from all over Greece.
  2. PRODUCT MANUFACTURING DEFECT: In those cases where there is a defect in the product you have the right to return the product you purchased and request its replacement with another product or products up to the amount of the price you have paid or at an additional price if you wish, within 14 calendar days from the receipt of the product.   3. PRODUCT CHANGE: In cases where you wish to change the product you purchased, you must fill in the contact-mail product code or codes and size and our partner will contact you. Alternatively, you can contact customer service directly at 2610 277734. In case the product is defective, you can return it within 14 days (once per order), always after consultation with the customer service department 2610 277734 (Shop Hours) and only through the courier company with which we cooperate.
  4. WITHDRAWAL: You have the right to return the product you purchased, exercising the right of withdrawal and – only if the product has not been used – to request the refund of the price you paid us, within 14 days from the date indicated on the proof of purchase. The return of the product should be made with any courier you wish and the costs of the return are borne by the customer. A refund is made for the purchase of the product made in cash (cash on delivery), and a credit card. The refund process will be completed no later than 30 days from the date of receipt of the products and if they are in excellent condition. The products, which have been purchased from the online store “adamkosmima.gr” can be changed or returned to one of the company’s physical stores, always after consultation with the customer service department 2610 277734 (Shop Hours).

OTHER TERMS OF THE UNDERTAKING

The free shipping and return is valid only for orders that will be executed through our online store www.adamkosmima.gr. In case the customer places his order through a site and changes with a different design of lesser value through our physical stores he will have to find a product of equal value to the one he had purchased through the site or if he wishes a product with greater value he will have to pay the difference. The same happens for higher value purchases where the difference will not be calculated by the price of the site (the new plan) but by the price of physical stores. In special discount periods, such as BlackFriday, CyberMonday, etc., the special discount rates apply exclusively. They are not combined with other discount campaigns and neither the issuance nor the redemption of discount coupons are accepted.
